Marialena Constantinou

Marialena Constantinou specialises in private client advice and in international commercial litigation. She is currently leading the firm’s Private Client Services.

With a particular emphasis on recognition and enforcement of foreign judgments and interim injunctions, including worldwide freezing orders, gagging and disclosure orders, Marialena has acted in complex litigation involving foreign parties from many emerging markets such as Russia and the CIS, Central and Eastern Europe and Asia.

She is a member of the Chartered Institute of Arbitrators and an accredited Civil and Banking Mediator thus she often uses her alternative dispute resolution training to help provide a blend of an empathetic and supportive approach with academic expertise to her clients' cases. With her substantial experience in dispute resolution, Marialena is able to advise private clients on a whole range of problematical issues as well as a range of commercial and residential property matters, with a particular strength in advising on citizenship by investment involving complex business transactions.

She has participated in numerous conferences and events worldwide and her unique experiences over the past years have shaped her into a practical, strategic and commercial lawyer with a client-focused approach to her work.

Marialena holds a Bachelor of Laws from the University of Manchester and a Master of Laws in Corporate & Commercial Law from the University of London. She is a member of the International Bar Association and of the International Young Lawyers Association.

Marialena qualified as an Advocate in 2011.

• Acting for a leading South African manufacturing company in relation to a breach of contract claim brought before the Malaysian High Court and the Singapore Centre of International Arbitration;

• Acting for the plaintiff subsidiary companies of one of the largest Russian aluminium production firms in proceedings involving claims for fraud, procuring breach of contract and unlawful means conspiracy;

• Acting for a Lebanese businessman involved in an action for passing off and breach of contract filed by a leading construction company in Greece;

• Acting on behalf of a Cyprus developer against a UK based construction firm involving claims for breach of contract and raising procedural matters of interpretation of service out of jurisdiction within EU member states;

• Acting for a Ukrainian individual in relation to a dispute as to beneficial ownership of a broadcasting TV channel which is part of a Cypriot structure involving Ukrainian subsidiaries;

• Acting for a Ghana based bank in a tracing action against a Cypriot company and a local bank and simultaneously obtain interim disclosure orders;

• Advising the Ukrainian UBO of a Cypriot company in relation to the Deposit Guarantee and Resolution of Credit and Other Institutions Scheme of a foreign bank whose license was suspended by the Central Bank of Cyprus;

• Advising a Chinese agent in respect of numerous contracts of sale entered into by his clients with a Cypriot developer under the Cypriot Permanent Residence Program;

• Advising a Romanian based bank in respect of a Subrogation Agreement between a Moldovan and a Cypriot company and the applicability of Cyprus law;

• Acting on probate and estate administration issues related to the re-sealing of the Will of a Cypriot businessman, knighted by the Queen of England, residing in Papua New Guinea;

• Acting for the Russian beneficial owners of a Russian subsidiary company of a Cyprus holding company, involved insolvency proceedings arising from complex financing structures by a leading private Russian bank to facilitate commercial activities in Russia;

• Acting on behalf of a Russian high net worth individual to regain control of a complex corporate structure acquired by him using nominee shareholders and directors in Cyprus who had threatened to dispose of his interest without his knowledge or consent;

• Acting for a Russian UBO of a Cypriot holding company and arranging for the enforcement of a settlement agreement before the Cyprus court;

• Advising a leading Swiss company in citizenship and residence planning to set up and establish its operation in Cyprus;

• Advising a leading Ukrainian energy production and supply company in all matters related to the applicable commercial context of establishing and operating solar power plants;

• Acting for a UK real estate agent company in a very substantial dispute relating to the construction of the biggest wind farm in Cyprus;

• Acting for a BVI company and Claimant in LCIA arbitration proceedings against a Cypriot company in respect of interim freezing and disclosure orders in aid of the arbitration;

• Acting for the registration and enforcement of an Irish judgment on the shares of a Cypriot company;

• Advising a Chinese HNWI in acquiring the Cypriot citizenship and simultaneously obtaining custody of his child by enforcing a settlement agreement issued in China;

• Advising a Russian HNWI in acquiring the Cypriot citizenship and setting up a business structure in Cyprus;

• Acting for a Ukrainian businessman in extradition proceedings upon the request of the Russian Federation and dismissing the proceedings on the basis of the expiration of the warrant;
