Renewed injunctive protection against an imminent auction

Urgent relief where enforceability, limitation and mortgage rights intersected.

An urgent enforcement threat

A creditor announced a new public auction of two properties charged under a mortgage created decades earlier. The secured debt had previously been the subject of an arbitral award and a registered judgment, but the period during which that judgment could be executed had expired.

The intended auction created a direct risk that the principal action would lose its practical value. If the properties were transferred before trial, a later judgment in the owner’s favour could not readily restore the position.

The legal tension

The application involved the expiry of the registered judgment, the juridical autonomy of the mortgage and the statutory rule treating mortgage-realisation proceedings as an action subject to a twelve-year limitation period.

The creditor maintained that the mortgage was an independent source of rights. The court therefore had to decide whether protection was justified without finally determining accrual, limitation, the relationship between the award, judgment and mortgage, or the alleged settlement.

Our litigation strategy

We framed the case around the proper function of interlocutory relief. The application demonstrated that coherent legal questions required determination at trial and that the scheduled auction would overtake that trial unless restrained.

Particular emphasis was placed on the chronology and on connecting the declaratory remedies to the properties themselves.

Result and practical significance

The court granted the interim injunction restraining disposal of the two properties until completion of the action and awarded costs to the applicant. The substantive issues remain for final adjudication.

The decision highlights the interaction of arbitral awards, registered judgments, mortgages and limitation rules, as well as the need to act promptly once an auction is scheduled.
